A federal judge in Delaware said he would grant Intel’s motion to dismiss a derivative shareholder suit that was prompted by antitrust allegations against the chip maker, reports The Wall Street Journal.
The suit names current and former Intel directors, alleging they failed to prevent the company from committing anti-competitive practices to monopolize the market for microprocessor chips. The suit was filed by rival Advanced Micro Devices.
U.S. District Judge Joseph Farnan, who is presiding over all the cases, ruled Thursday that the complaint naming Intel directors should be dismissed. The judge wrote that the plaintiffs failed to meet legal standards for bringing such an action. He ruled that the plaintiffs should have brought their concerns to Intel’s board of directors, or made a case that such an approach would have been futile.
