Maker’s Mark Sues Over Wax Seal Copying

The suit filed this week in Louisville names the maker of the tequila Jose Cuervo Reserva de la Familia as a defendant, along with Diageo North America, which distributes the tequila in the U.S.

Maker’s Mark Distillery has filed a federal lawsuit accusing some competitors of a trademark infringement by allegedly copying the Kentucky bourbon maker’s red wax seal. The suit filed this week in Louisville names the maker of the tequila Jose Cuervo Reserva de la Familia as a defendant, along with Diageo North America, which distributes the tequila in the U.S., reports the Associated Press. Maker’s Mark claims the red wax coating on the tequila has spurred purchases by some people who mistakenly think the product is connected with Maker’s Mark. Attorneys for the defendants declined to comment, saying they hadn’t thoroughly reviewed the suit.
